1. Acceptance
By accessing kestrel.in or the Kestrel API, you accept these terms. If you accept on behalf of an organization, you confirm authority to bind it.
2. Account
You are responsible for activity under your account and API keys. Notify us within 24 hours of any compromise. We may suspend accounts for abuse, fraud, or non-payment.
3. Permitted use
Use the data only for lawful business purposes consistent with the Indian DPDP Act, 2023. Do not use the data to harass, profile vulnerable groups, or contact data principals who have opted out.
4. Prohibited use
Resale of the dataset without a licensing agreement, reverse engineering, scraping, building a competing index, sending spam at scale, training third-party LLMs without consent, attempts to re-identify redacted records. Each is a material breach.
5. Credits and quotas
Credits are non-refundable. Unused credits expire 90 days after billing cycle end. Quotas reset at the start of each billing cycle.
6. Pricing and billing
Prices on the pricing page are in INR and exclude 18% GST. Razorpay processes billing. Failed payments suspend the account after a 7-day grace period.
7. Service level
API uptime target is 99.9% on Growth and Scale plans, 99.5% on Starter. Refunds for downtime are computed pro-rata on the billing cycle.
8. Cancellation
You may cancel any time from /app/billing. Cancellation takes effect at the end of the current billing cycle. We may terminate for breach with 7 days notice.
9. Liability
To the maximum extent permitted by Indian law, our liability is capped at the fees paid in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.
10. Disputes
These terms are governed by the laws of India. Exclusive jurisdiction lies with the courts of Bhubaneswar, Odisha. Pre-litigation mediation is required.
11. Changes
Material changes will be posted here with a dated entry and emailed to account owners 14 days before taking effect.
